APPs case: Tripura HC delivers verdict in favour of ‘deprived’ candidates

In a major setback to the BJP-IPFT government, the High Court of Tripura has rejected the appointment of five Asst Public Prosecutors (APPs) for violating guidelines and the merit list prepared by the District Magistrate (DM), Gomati district.

Side by side, a division bench comprising Chief Justice Akil Kureshi and Justice Arindam Lodh asked the government to appoint two 'deprived' candidates by next two months.

Law department, ignoring the guidelines and merit list prepared by the DM, Gomati district, had appointed five APPs in June 2018. Interestingly, two advocates- Bapi De and Joyseh Dey, who had topped the merit list, were not given appointment raising many questions.

Disheartened by the development, the duo had lodged a PIL in the High Court challenging the appointment of five APPs. Measuring the gravity of the case, a single bench referred the case to the Division bench.

After hearing the case, the division bench rejected the appointment of five APPs yesterday as their appointment was against the law. In the order, the court asked the government to appoint two deprived lawyers for the post of APPs.

While passing the judgment, the court observed that the appointment of APPs is important and it must follow the guidelines to ensure transparency
