Tripura govt directed to compensate on medical negligence
AGARTALA: The High Court of Tripura asked the Left Front government to pay Rs. 5 lakh as compensation for death of a patient following medical negligence at GBP Hospital, first referral hospital of the State two years back.
The State government would have to pay the fine to the patients' mother Tarubala Das by the next three months, according to the verdict of the High Court's division bench – Chief Justice Deepak Gupta and Justice Subhasish Talapatra.
Tarubala Das, resident of Belonia in South Tripura District brought her ailing son to the hospital in the beginning of 2013. She requested to the doctors and nurses to treat him, but no one responded to her plea. As a result, Shyamal Das, 21, died unattended within 24 hours of his admission in the hospital. Deepak Gupta took a suo motto case after the incident published in a local newspaper.
The court asked to form an investigating team led by Health Secretary M Nagaraju to probe into the incident. The rest of the members are retired physician Dr. Partha Sarathi Chakraborty, incumbent school Education director Dr. JK Debbarman, retired district and session judge – SC Saha, incumbent High Court Bar Association president Pijush Kanti Biswas.
During investigation, the team found acute medical negligence led to Shyamal's death. He was lying in the hospital without treatment for the whole night and he breathed his last in the next early morning. Two doctors and two nurses were found guilty in the incident.
On the basis of the team's report, Deepak Gupta asked the State government to take action against those doctors and nurses. However, no action has been taken against them.
